THE DEATH SENTENCE HAS PROVEN AN EFFECTIVE MEANS OF CONTROLLING CRIME YET IT IS OUTLAWED BECAUSE OF MORAL REASONS. AT WHAT POINT SHOULD LOGIC PREVAIL OVER HUMAN COMPASSION |
A death sentence also known as death penalty or
capital punishment, it is a legal punishment of the crime which is given to the
criminal by death. Such type of punishments reduce the crimes that are against
the law such as murders, drug crimes, harassments and other wrong doings.
Mostly the death sentence is given to the criminal for murders.
Everyone believes that human life is very valuable
some of those are against to the death sentence due to the humanity. They
believes that the value of the criminal's life should not be destroyed by the criminal's
crime, even they have killed someone. While Archbishop
Desmond Tutu said that to take a life when a life has been lost is revenge, it
is not justice. It's argued that revenge is used in a unique way in the case of
the death sentence. While the Islam on the whole
accepts death sentence, these two Qur’anic verses 6:151 and 6:165 allow the
death sentence in two cases. The first case is for murder and the second case
applies to crimes committed against the community which depending on who is
interpreting the Qur’an, including: treason, apostasy, terrorism, piracy, rape,
and adultery.
The medieval philosopher and theologian Thomas Aquinas made this point very clearly that if any man is dangerous to the community and is subverting it by some sin, the treatment to be commended is his death sentence in order to maintain the common good, as Aristotle points out, an evil man is worse than a beast and more harmful. Death sentence is often defended on the grounds that society has a moral obligation to protect the safety and welfare of its citizens. Murderers threaten this safety and welfare. Only by putting murderers to death can society ensure that convicted killers do not kill again. Death sentence benefits society because it may prevent violent crime.
In general, since society has the highest interest in preventing
murder and other crimes, it should use the strongest punishment available to
deter murder and crimes, and that is the death sentence. If murderers are
sentenced to death and executed, potential murderers will think twice before
killing for fear of losing their own life.
